Every several months media outlets publish articles about various researches predicting a severe earthquake in Israel and urging to prepare the public and enhance buildings for such an eventuality.

If an earthquake will, indeed, take place in Israel, it will not be the first time. A series of earthquakes happened in the region in the distant past, the last of which took place in 1927, when 500 people were killed.

It is therefore not surprising that our region is susceptible to earthquakes since it is located within the Great Rift Valley, linking two tectonic plates.

Earthquakes are usually caused pressured is released between the tectonic plates. This sudden release of energy causes the seismic waves that make the ground shake. If the area is inhabited then in the event that buildings are not built properly, property will be damaged and lives may be lost.

How does the National Outline Plan No. 38 (TAMA 38) helps to deal with earthquakes?

In 2005, the Israeli government approved TAMA 38, or in its full name – the National Outline Plan for Enhancing Existing Buildings to Withstand Earthquakes.

This plan is intended to encourage the enhancing of old building such that they withstand earthquakes in accordance with clear rules and procedures drawn up by expert engineers and architects.

The plan includes

  • Enhancing buildings that were built prior to 1980 to withstand earthquakes.  (It is estimated that buildings built prior to that year do not comply with the Israeli standard relating to earthquakes, set in 1975).
  • Encouraging the enhancing of buildings by adding building rights.
  • Erecting two additional floors in buildings in order to increase their area.
  • Expanding existing flats provided that such expansion includes a protected space.
  • Adding elevators, parking spaces, and protected spaces.
  • The plan approves the demolition of the entire building and rebuilding it in accordance with the plan’s building rights and enhancing the building in accordance with the rules.

The Israeli government stipulated that the different additions may be carried out in order to encourage residents to execute the plan, i.e., encourage the enhancing of the buildings to withstand earthquakes. In terms of the costs, the government provides tax exemptions and reliefs in order to support and encourage engagement with the plan.

How is the building enhancing process being carried out?

Once residents decide to implement a TAMA 38, they meet engineers and architects that assess the building and provide residents with an overall plan for enhancing the building and expanding it in accordance with the existing building rights.

For a plan to be approved for a building, two third of its residents should agree to it. It is only then that the plan is considered approved and a bank loan can be extended in respect thereof.

The plan will be executed by the Company and throughout the process a contact person on behalf of the Company will work with residents’ representatives with the aim to complete the project on a timely basis to the satisfaction of all parties.
